The mark is a sign that is capable of distinguishing the goods or services of one person from those of other persons and can be represented in the State Register of Marks in a way allowing a clear and precise definition of the subject of protection, provided by the registration. Such signs may be words, including the names of persons or letters, numerals, drawings, figures, the shape of goods or of their packaging, or combination of colors, sound signals or any combination of such elements.
Signs that cannot be represented graphically but possess distinctive capacity also satisfy the definition of a mark, such as: sound marks, aroma marks, taste marks, multimedia marks, hologram marks, marks comprising motion, etc.
A mark may be a trademark, collective mark or a certification mark.
The right to a mark is an exclusive right and is acquired by registration counted from the filing date of the application.
